These Terms of Service (“Terms”) govern your access to and use of the SendForge website and services (the “Services”). By accessing or using the Services, you agree to these Terms.

1. Eligibility and accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2. Acceptable use

You agree not to use the Services to:

• Send spam, unsolicited messages, or content that violates applicable laws or regulations.
• Send unlawful, harmful, abusive, harassing, infringing, or deceptive content.
• Transmit malware or attempt to gain unauthorized access to systems or data.
• Interfere with the operation or security of the Services.
• Violate telecommunications rules, including requirements related to SMS/email consent and opt-out mechanisms.

3. Messaging compliance

If you use SendForge to send SMS or email, you represent and warrant that you have all required rights and consents to contact recipients, and that you will honor opt-out requests and comply with applicable laws and carrier requirements. We may suspend or terminate accounts that violate these requirements.

4. Early access / beta features

Some features may be labeled “early access,” “beta,” or “preview.” These features are provided “as is,” may change, and may be discontinued at any time. We may limit availability to certain users.

5. Fees and payments

If paid plans are offered, fees, billing frequency, and any usage-based charges will be disclosed at the time of purchase. Taxes may apply. Unless required by law, fees are non-refundable.

6. Intellectual property

We and our licensors own all rights, title, and interest in the Services, including software, branding, and content (excluding your content). You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

7. Your content

You retain ownership of content you submit or transmit through the Services. You grant us a license to process your content solely to provide and improve the Services, including delivering messages, generating analytics, and ensuring compliance.

8. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, pose a risk, or if required by law. Upon termination, your right to use the Services will cease.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SENDFORGE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

11. Changes

We may update these Terms from time to time. The “Last updated” date indicates when changes were last made. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
